Are Online Casinos Legal in Texas?
Online casino gambling is not yet legal in Texas. As of December 2024, the state does not issue licenses to allow online casinos to operate within its jurisdiction. In fact, Texas currently prohibits online sports betting, online pari-mutuel wagering on horse racing, virtual poker, and all other forms of Internet gambling.
The Lone Star State does have two land-based casinos: Kickapoo Lucky Eagle Casino Hotel and Naskila Casino. These are owned by two of the state’s federally recognized Native American tribes and authorized to offer Class II gaming (i.e., electronic bingo games that are similar to slot machines) on their reservations under the Indian Gaming Regulatory Act (IGRA).
Texas does not permit Class III gaming (which includes traditional casino-style games such as blackjack, roulette, and poker) at tribal casinos, but casino-style gambling is available on certain cruise ships that depart from the state’s ports and travel into international waters. Texas Lottery games, in-person pari-mutuel wagering on horse and greyhound racing, charitable bingo, and charitable raffles are the only other forms of legal gambling offered in the state.
When Will Online Casinos Launch in Texas?
It is currently unknown if or when the dream of online casinos in Texas will ever become a reality. While mobile sports betting has become widely available in the U.S., with well over half of all states having already legalized online sportsbooks, online casino gambling has not managed to grow at the same rate. Today, only seven U.S. states allow traditional online casinos to operate within their borders: Connecticut, Delaware, Michigan, New Jersey, Pennsylvania, Rhode Island, and West Virginia.
There is, however, reason to believe that the Lone Star State will permit commercial casinos to open in the near future. In March 2023, Texas legislators introduced House Joint Resolution (HJR) 155, which would pave the way for eight resort casinos to launch and begin offering Class III gaming to their customers.
HJR 155 was backed by Las Vegas Sands Corporation, a global leader in the casino and resort industry, but strongly opposed by the state’s tribal casinos, who worried that these new locations would threaten their existing operations and revenue. Ultimately, the bill died in the Texas House of Representatives in May 2023, but efforts to expand Texas’ gaming market will not stop and will likely gain further support in the upcoming years.
Different Types of Texas Casinos
Texas casinos can be divided into three distinct categories: online casinos, sweepstakes casinos, and land-based casinos. The similarities and differences between each option are discussed in detail below.
Online & Mobile Casinos
Online and mobile casinos are virtual platforms where players can enjoy a wide variety of casino games through their computers, smartphones, or tablets. These casinos operate on the internet, allowing players to access games and place bets remotely from the comfort of their own homes or while on the go.
Online casinos offer a range of games, including slots, table games, live dealer games, and much more. They typically require players to create an account, deposit funds, and use digital payment methods to play for real money. Unfortunately, traditional online casinos are not yet legal in the state of Texas.
Social & Sweepstakes Casinos
Sweepstakes casinos, also commonly known as social casinos, are free-to-play platforms that allow players to participate in a wide variety of casino-style games for a chance to win real cash prizes. These casinos operate under a sweepstakes model, and players can obtain entries to the sweepstakes through various means, such as purchasing virtual currency or participating in promotional activities.
Players do not directly wager real money in sweepstakes casinos, but they have the opportunity to win cash, digital gift cards, and other incredible prizes through luck and well-thought-out strategic play. Sweepstakes casinos provide an entertaining and engaging experience, and they are completely legal in the state of Texas.
Land-Based Casinos
Land-based casinos are physical establishments that offer a wide range of gambling activities. These casinos are typically built as large resorts or standalone establishments and house various casino games, including table games like blackjack, poker, roulette, and slot machines.
In addition, they often provide amenities such as restaurants, bars, entertainment venues, and accommodations. Land-based casinos require players to be present on-site to participate in gambling activities, and they usually operate under strict regulations and licensing requirements.
These casinos provide a vibrant and immersive gambling experience, where players can interact with dealers and other players in a lively atmosphere. There are currently two land-based casinos in Texas, (Kickapoo Lucky Eagle Casino Hotel and Naskila Casino), and they are each owned and operated by one of the state’s federally recognized Native American tribes.

Other Forms of Legal Gambling in Texas
In addition to land-based casinos, there are several other forms of legal gambling available in Texas. A general overview of the different options currently available is provided below.
Sports Betting
Sports betting is not yet available in Texas, though there has been major support from many of the state’s legislators and professional sports teams in recent years to legalize the activity. If it were to become legal, there’s a good chance Texas would quickly become one of the most profitable sports betting markets in the United States.
However, since the state’s 2023 legislative session came to an end without sports betting legislation being passed, Texas residents will have to wait until at least 2025 (since the Texas Legislature only meets in odd-numbered years) to see the launch of online or retail sportsbooks in the Lone Star State.
Horse Racing
On the other hand, betting on horse racing is currently legal and regulated in Texas. The state has several licensed racetracks where live horse racing events are held, providing an opportunity for enthusiasts to enjoy the thrill of the races and place wagers on all their favorite horses. Some notable racetracks in Texas include Lone Star Park in Grand Prairie, Sam Houston Race Park in Houston, and Retama Park in Selma.
In addition to live racing, off-track betting (OTB) facilities are available in Texas, allowing individuals to place bets on horse races taking place at other tracks across the country. However, online racebooks, such as TwinSpires or AmWager, are not authorized to operate in the state, meaning all betting on horse racing must be done in person.
Daily Fantasy Sports
Texas residents also have the opportunity to engage in daily fantasy sports (DFS) through DraftKings, FanDuel, Underdog Fantasy, OwnersBox, and many other popular DFS sites and apps. While the state of Texas has not explicitly legalized DFS, it does allow its residents to participate in paid contests offered by these platforms.
This permissive stance enables Texas DFS enthusiasts to join a wide range of contests, showcase their skills in creating virtual teams, and compete against fellow participants for cash prizes. By embracing these DFS options, individuals in Texas can enjoy the excitement and strategic elements of fantasy sports while potentially earning rewards based on the performance of real-life athletes.
State Lottery
The Texas Lottery is a legal and popular form of gambling in the state. It offers various lottery games, including scratch-off tickets and draw games like Powerball and Mega Millions. Players can purchase tickets from authorized retailers across Texas and have the chance to win huge cash prizes. The Texas Lottery proceeds are dedicated to supporting education and veterans’ services in the state, contributing to important public causes.
Charitable Gaming
Charitable gaming in Texas is legal and regulated, allowing non-profit organizations to organize certain types of games to raise funds for charitable purposes. Common forms of charitable gaming in Texas include bingo games and raffles. Non-profit organizations that meet specific criteria can obtain licenses to conduct these gaming events. The state imposes restrictions and oversight to ensure compliance with regulations and to safeguard the integrity of charitable gaming activities.

Strategies & Tips for Texas Casino Players
While there is no foolproof method to guarantee success during casino play, there are plenty of general guidelines to follow and strategies to implement to increase your chances of success. Here are a few of the best tips and tricks for Texas casino players:
- Explore Different Game Variations: Within each casino game category, there are often different variations available. Take the time to explore different versions of games like blackjack, poker, or roulette to find the ones that suit your preferences and offer favorable odds.
- Study Game Odds & RTP: Take the time to research and understand the odds and Return to Player (RTP) percentages of different casino games. Focus on games that offer higher RTPs, as they tend to provide better long-term winning potential.
- Stay Calm & Composed: Maintain a calm and composed demeanor while playing casino games. Emotional decision-making can lead to poor choices and unnecessary risks. Stay focused and think logically throughout your gaming experience.
- Avoid Gambler’s Fallacy: The gambler’s fallacy is the mistaken belief that previous outcomes in gambling will affect future outcomes. Remember that each round or spin is independent, and past results have no influence on future ones. Approach each game with a fresh perspective.
- Know When To Quit: Set win and loss limits before you start playing and have the discipline to walk away when you reach them. Avoid chasing losses and be satisfied with your wins, as gambling should be an enjoyable experience, not a desperate attempt to recover losses.
- Learn From Others: Engage with experienced players, join forums or communities, and learn from their strategies and experiences. Sharing knowledge and insights can enhance your understanding of the games and help you improve your skills.
